First-Time Buyers Looking To Invest In Dubai Property Should Be Aware Of Several Elements

While Dubai’s real estate sector is enjoying an increase in completed residential properties, there are many elements that a new purchaser should be aware of when considering purchasing a property such as the following.

Power of attorney

Foreign first time purchasers should bear in mind that they can actually complete the transaction as per the title on the property. No party may act on or on behalf of a party without being the legal authorized signatory with the specific powers delegated to them in a Power of Attorney (POA). This POA can often cause extensive delays in particular if one of the parties is not in the UAE and an international POA will be required to be notarized and fully attested by the UAE Consulate in the country of origin in addition to the Ministry of Foreign Affairs and legally translated in the UAE. This POA can often end up being quite costly.

Corporate structures

If the property being sold is owned by a company or if the buyer is a company, there may be a complex and detailed list of companies, known as a holding structure involved, often in multiple jurisdictions such as JAFZA, or BVI which will require all relevant, original up-to-date company documents to be fully attested and translated which often leads to costly and extensive delays, if not managed correctly.

Special interests, probate, minors, companies

Buyers may purchase a property in their child’s name, or under a company where their child is a shareholder of which at the time of the purchase is quite easy for the purchaser. However, when it comes to reselling this property, special permission is required from Dubai Court, whereby, the court will act as the trustee and permission shall be sought prior to completing the sale. This is also the case for a will of a deceased person, whereby a Grant of Probate is required from Dubai Personal Status Court.

Financing

While some purchasers opt to finance the purchase by way of a mortgage, most sales agreements will have a no-fault release clause. If the new purchaser fails to obtain the mortgage, they shall be released from the contract with no fault or liability afforded to them. However, in some instances the purchaser may be delayed or prohibited from obtaining some or all of the funds required to complete the mortgage application such as a failure to secure the lay down funds for the mortgage. This will cause the purchaser to default on the sale and be potentially liable to lose their security deposit, with essentially no fault of the purchaser.

Advanced payment and outstanding liabilities

Often a mortgaged property shall require a mortgage clearance letter. To sell the unit, the seller may have an outstanding liability due to the developer or a bank, which they are not able to clear prior to the sale. In these cases, the seller will require the purchaser to pay off and clear any outstanding sums owed on behalf of the seller. This means that the purchaser will be paying funds on behalf of the seller, on a property that is not yet in the name of the purchaser.  In order to protect the purchaser’s funds, specific securities can be placed on the property before the Dubai Land Department so that the seller receiving the benefit of having the purchaser clearing their mortgage. Then they can proceed to sell the unit to a third party.

In practice, there are many potential dangers for purchasers, when entering into a sales & purchase agreements (SPA), however, with practical and well renowned legal advice, in addition to a well SPA the potential purchaser may mitigate any possible liabilities and in turn facilitate a successful transfer and avoid possible litigation.

Dubai has been registering an uptick in property sales transactions in the last six months.

Secondary, ready villas, and townhouses are in high demand as per Dubai Land Department. But it is not just the ‘glut’ in the market that is driving this upswing.

The prices, too, are reporting an upward trend for the last six months. The rising interest in the mid-to-high housing market reflects a paradigm shift in mindset brought about by the pandemic, say experts.

The novel coronavirus disease (Covid-19) pandemic forced digitization on us. It imposed a change where our homes are no longer just a sanctuary for relaxation but double up as office space, too. They don’t mind longer commutes to work, which in most cases have been reduced to once or twice a week or less, for a space that is more comfortable

And while families and individuals look for bigger adobes, the interest invariably has been more in communities. “Gated communities have been of much interest in Dubai in the last six-eight months. This applies to both for rentals and sale. More and more families are appreciating the lifestyle that they can afford in a community with parks, walkways, organized commercial spaces like malls, etc., in community living as opposed to living in a standalone building.

Prices have bottomed out, at least in the mid-to-high and luxurious sectors. Lower down payments, a dip in interest rates, improved loan to value ratio, and Dubai’s image of a safe haven for investments are largely the reasons for the uptick in demand and prices in this segment.

“Uber luxurious properties have seen a spike in demand, thanks to European buyers. Since the opening of Dubai in July, we’ve seen quite a few high net-worth transactions.

Quality prime real estate is not available in abundance anymore. Constructions over 15 years old have started showing signs of aging. Now, buyers are willing to pay a premium for the new ones. The price for a house in Shoreline apartments on Palm Jumeriah, for instance, starts at Dh1,100 to 1,200 per square feet. Comparatively, prices average at Dh4,000 per square feet at the Royal Atlantis, which is also at Palm Jumeriah. “People are willing to pay top dollar for good quality development in the same area.

Similar variations are also seen in the JBR neighborhood, where old apartments are selling at Dh1,000 per square feet, and apartments at One JBR, a new construction, are being sold at a minimum Dh4,000 square feet.

Should you buy?

For now, it is only the high-end properties that have seen an uptick in prices and demand. It is expected to have a pull effect on other low-to-mid segments too this year. Rents and sale prices will eventually rise across the board by the end of this year, say experts.

Now while we are at it, there is always this debate among expatriates on whether to rent or buy a house. One way to reason is to know how long you plan to stay in the country. If you can pay the same rent amount for 10 to 15 years then the house is yours. You have to do the math.

But is it a good time to buy? Well, that really depends on your financial health rather than the prices dictated by the realty sector right now. “Invest what you can spare. The whole economic environment is a bit volatile even now. We expect it to be better in six months, but this is not a time to be aggressive. If you have a buffer, an emergency fund that will protect you from any untoward experience, then buy.

Egyptian billionaire is all praise for Dubai and the world is flocking to the emirate after its successful handling of Covid-19 pandemic that led to the opening up of the economy and return of tourists.

“The World is moving to Dubai … cheers to Dubai,” tweeted Naguib Sawiris, chairman and CEO of Orascom Investment Holding.

The 66-year-old Sawiris, who owns assets worth $3 billion, is the highest-ranked foreign investor who acknowledged that Dubai is rising fast in the post Covid-19 period.

Even some analysts have also recognized the emirate’s success story and betting on strong recovery in its strategic sectors retail, hospitality and tourism with the arrival of Covid-19 vaccine.

It is estimated that the emirate’s economy will expand four per cent next year on the back of effective policy measures taken by the emirate’s government that will drive increased investment inflows and job creation in the coming years.

London-based research consultancy has stated that Dubai stands out in the Middle East for adopting protective measures to contain the pandemic and is one of the major beneficiaries of the vaccine.

“Dubai, which stands to be among the biggest beneficiaries from a vaccine, has received a shot in the arm with the news that tourists will flock to the Emirate over the next month,” said Capital Economics.

“Dubai has also been boosted by the establishment an air travel corridor with the UK, traditionally the source of around 7% of all tourists. All told, this should provide Dubai with a short-term boost to round off a year where the economy has been hit particularly hard by the effects of the pandemic,” it added.

Dubai climbs the Global Real Estate Transparency Index after launching official residential index

Dubai and Abu Dhabi are the most transparent real estate markets in the MENA region, according to the latest Global Real Estate Transparency Index from JLL.

The index is considered a useful indicator of a city’s overall ‘real estate investment health’ and comes despite continued concerns surrounding over-supply and the ongoing economic impact caused by the global Covid-19 pandemic.

Dubai’s increasing attractiveness as an investment hub was recognized as the emirate climbed up three places to 36th.

According to the report, the most significant initiative launched in 2019, and a key contributor to Dubai’s ranking, was the creation of an official residential transaction-based index, Mo’asher, by the Dubai Land Department (DLD) in partnership with the private sector.

“Mo’asher constitutes a potentially important step forward for Dubai, as it means the establishment of a single index that is widely used by all market participants,”

Abu Dhabi also emerged as a top performer globally, reflecting positively on the overall transparency ranking and future investment outlook.

Among the many initiatives introduced, the UAE Ministry of Climate Change and Environment signed a pledge with the Abu Dhabi Global Market (ADGM), a financial free zone, to embed sustainable finance policies in the UAE, contributing to the emirate’s ranking. The policies cover all forms of corporate and investment financial services which yield environmental, social, and economic benefits.

The report also revealed that Saudi Arabia is demonstrating a strong commitment to reforms to expand the economy and real estate market, including rebranding its publicly available central database – The General Authority for Statistics – and continuing to collate more data from government agencies

Arabian Ranches, The Lakes, Palm Jumeirah, and Jumeirah Islands were among the communities that registered small increases in prices last month.

The overall Dubai property market displayed monthly stability, with an average fall in values of just 0.2% compared to October, the lowest rate of decline in three years.

It added that, annually, transactions for off-plan homes dropped 51.5%, but ready homes improved 18.1%. However, given the high demand due to record low prices per square foot, villas demonstrated higher resilience when compared to apartments.

Most villa freehold locations saw prices stabilize this month, and, in some areas, registered minor increases in capital values. Examples included Arabian Ranches, The Lakes, Palm Jumeirah, and Jumeirah Islands.

Top off-plan locations transacted during November were in Jumeirah Village, Tilal Al Ghaf, Business Bay and Downtown Dubai.

Most transacted ready homes were located in Dubai Marina, Jumeirah Village, Business Bay, Palm Jumeirah and Town Square.

Real estate business is a cyclical business. We have an oversupply, [but] Dubai is reasonably priced. Our prime time price was a little lower than Chicago prices. We are also going through what the world is experiencing. Good demand continues from India, Saudi Arabia, Russia and China.

Cavendish Maxwell data showed that 220,208 units have been delivered since 2009 while nearly 140,000 units have been handed over since 2014, showing huge supply that came online in the last few years. The supply peaked this year and going forward, lesser supply will come to the market as developers pull back and launch less projects.

Pre-Covid-19 sales were about $15 million a day and it crashed during the pandemic. But sales have now recovered to $12 million a day.

The Emaar chief noted that the company is taking care of stocks now. “Government entities have been wise on the supply side. The entities decided to stop new developments a year back.”

“What the UAE has done in healthcare and security shows that this place is safe for our families and great place to move in. Hence, a lot of families are moving in to the UAE.” says Emaar’s Mohamed Al Abbar.
